Kuni German Motors, LLC  (referred to as “Kuni BMW,” and “we”, “us”, “our” and similar terms throughout) respects the privacy of the information that is entrusted to us.  We also respect the rights of those with whom we interact.  This Privacy Policy is intended to provide transparency about our data collection, security, and sharing.  This Privacy Policy describes the categories of information we collect, the purposes for which we use that information, and our processes and policies regarding the use and protection of that information.  We urge you to read this Privacy Policy so that you understand our commitment to you and your privacy, and how you can participate in that commitment.

This Privacy Policy applies to both the online and offline collection of information by Kuni BMW.  By visiting our website or using any of our services (defined in Section III, below), you acknowledge that you consent to our collection, use, disclosure, transfer and storage of information as set forth in this Privacy Policy.

    III.            The Information That We Collect
We collect information to provide our services, which include selling and servicing vehicles and vehicle parts, and to perform other functions related to those services (collectively, the “Dealership Services”).

Personally Identifiable Information

The information we collect includes the following: personal identifiers, such as name, address, date of birth, gender, and contact information; financial information in connection with a transaction, such as credit card number and bank account information; commercial information such as your purchase history; and professional or employment-related information.

Non-Personally Identifiable Information

We may collect information that is related to you but that does not personally identify you (“non-personally identifiable information”).  For example, any time you visit our website, we may gather certain information regarding the means you use to access our site.  This information may include the type and version of your browser, your service providers, your IP address, and any search engine you may have used to locate the site.  We use this information to help diagnose problems with our server, administer our website, and compile broad statistical data.  In addition, we gather certain navigational information about where you go on our website.  This information enables us to determine which areas of our website are most frequently visited and helps us to tailor the sites to the needs and interests of our online visitors.  Such information is gathered by us in the aggregate and is not associated with a specific individual.

    IV.            How We Collect Information

Information Voluntarily Provided

Kuni BMW also collects the information you provide to us (i.e., name, e-mail address, etc.) when you interact with our business either online or in person.  You provide some of this information directly, and we get some of it by collecting information about your interactions and experiences with the Dealership Services.  The information we collect depends on the context of your interactions with Holman and the choices you make, including your browser privacy settings and the products and features you use.

Information Automatically Collected

Email Communication: We use pixel tags and cookies in our marketing emails so that we can track your interaction with those messages, such as when you open the email or click a URL link that are embedded within them. When recipients click on one of those URLs, they pass through a separate web server before arriving at the destination page on a company website. We use tools like pixel tags and cookies so that we can determine interest in particular topics and measure and improve the effectiveness of our communications.

Mobile Communication: When you download or use our mobile-device applications, or access our mobile-optimized website, we may receive information about your mobile device, including a unique identifier for your device.

Cookies and Similar Technologies: We may collect information about your use of the website through cookies and similar technology.  A “cookie” is a unique numeric code that we transfer to your computer so that we can keep track of your interests and/or preferences and recognize you as a return visitor to the website. Social Media Engagement:  Our website includes social media features, such as the Facebook “Like” button and other widgets that run on our site. These features may collect your IP address and which page you are visiting on our site and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our site. Your interactions with these features are governed by the privacy policy of the organization providing it. For example, if you create or log into your account through a third-party social networking site, we may have access to certain information from that site, such as your name, account information and friends, in accordance with the authorization procedures determined by such third-party social networking site. We may also collect information about you from other sources to help us correct or supplement our records, improve the quality or personalization of our services to you, and prevent or detect fraud. We work closely with third parties (for example, business partners, service providers, sub-contractors, advertising networks, analytics providers, search information providers, fraud protection services) to constantly improve our products and services and may receive information about you from them.

Information from Third Parties

We may collect information about you from third parties to provide or enhance the Dealership Services.  For example, we collect demographic and other information to improve the accuracy and relevance of our marketing efforts.  We also collect information from third parties to help us correct or supplement our records, improve the quality or personalization of our services to you, and to prevent or detect fraud.

      V.            How We Use and Maintain Your Information.

We use your information to provide you products and services, such as to fulfill your requests for products or to help us personalize our offerings to you.  We also use your information to support our business functions, such as fraud prevention, marketing, and legal functions.  To do this, we use personal and non-personally identifiable information, collected online and offline, including information from third party sources.

We understand the importance of your privacy and take the confidentiality, integrity, and availability of your information seriously.  To ensure the security of your information, we take reasonable physical, electronic, and managerial measures to safeguard and secure your information.

While we strive to ensure that your data is always protected, no data transmission can be guaranteed to be 100% secure.  Consequently, we cannot ensure or warrant the security of any information you transmit to us and you understand that any information that you transfer to us is done at your own risk.  By using the Dealership Services or providing your information to us, you agree that we can communicate with you regarding security, privacy, and administrative issues relating to your use of the Dealership Services.

    VI.            How We Share Your Information.

We understand the importance of your privacy.  We collect and maintain your information for our use in connection with providing the Dealership Services, and we do not disseminate your information to third parties other than as described below.
Business Partners:  We may partner with select retailers and other companies at various times to provide expanded services to our customers, including, for example, vendors, marketing companies, financial institutions, and government entities.
Agents:  We may use other companies and individuals to perform certain functions and Dealership Services on our behalf.  Examples include administering e-mail services and running special promotions.  Those parties only have our permission to access and use the information needed to perform these functions, and may not use or store the information for any other purpose.

Business Transfers:  If we sell or transfer all or a portion of our business assets, consumer information may be one of the assets that is transferred as part of the transaction.
Compliance with Law/Safety:  We may disclose your information in order to protect the legal rights of Kuni BMW, its affiliates, or their employees, agents, and contractors; to protect the safety and security of Kuni BMW’s customers; to protect the rights, property, and safety of Kuni BMW; or when legally required to do so, at the request of governmental authorities conducting an investigation, or to verify or enforce compliance with the policies governing the Dealership Services and applicable laws.

We reserve the right to change this Privacy Policy from time to time.  Such changes will be effective immediately upon publication unless otherwise specified.  We may elect to notify you of changes or updates to the Policy by various means, such as posting a notice on Kuni BMW’s website and/or by sending you an e-mail; however, we will not be required to provide any such notice.  We encourage you to periodically review this Privacy Policy to keep up to date on how we handle your information.

VIII.            Special Notice Regarding Minors

We respect the privacy of children of all ages and in particular recognizes the sensitivity of the information of children under the age of 13 (“Minors”).  Therefore, we provide this special notice to parents and legal guardians regarding the collection and use of the information of Minors.  The Dealership Services are not directed toward Minors.  We do not knowingly collect information from Minors.  In the event that we learn that a Minor has provided their information to us, we will delete such information as soon as possible.
